Motor Vehicle Accident Benefits Claims FAQ

In our physiotherapy clinics, we often treat those who have been injured in an MVA (motor vehicle accident) with whiplash which is associated with concussions, chronic pain management, injury rehabilitation and more. Car accidents are traumatic events which are extremely stressful and could be damaging to your health. Most Ontarians are not aware of the benefits they are entitled to receive after a car accident. If you were recently involved in a MVA, it’s important to know your benefits. Today, we break down some frequently asked questions which are commonly asked in our clinics, along with a brief explanation.

I was involved in a car accident but was at fault, am I still entitled to benefits?

Yes. Often times, people are unaware that they are entitled to benefits from a motor vehicle accident, even if they were at fault. Benefits apply regardless of who was at fault during the accident. That means the driver of the car in a single crash is entitled to benefits, or a cyclist who was struck by a vehicle. If you’re a pedestrian struck by a car, then you’re also entitled to benefits. The fact of the matter is, if you were injured in an accident due to the operation of a motor vehicle then you are entitled to benefits.

How do I access by MVA benefits?

Your insurance company must be notified of the car accident within seven days of the incident. At this point you will speak to your insurance company who will more than likely send you a package of documents to fill out. It’s imperative to fill out these documents and return it to them within 30 days after you have received them. Benefits are not payable until your insurance company has received these completed forms therefore it’s in your best interests to complete them as soon as possible. Even if you are covered through other policies, you should complete these forms via your insurance company because other policies may offer limited coverage.

Which treatment(s) is covered?

Examples of treatment covered by accident benefits include but are not limited to:

  • Treatment provided by healthcare professionals and medical professionals (doctors, physiotherapists, chiropractic care, psychological counseling)
  • Assistive Devices (walkers, crutches wheelchairs)
  • Transportation to medical appointments
  • Medications
  • Employment re-training
  • Modifications to your car

How much money is available for treatment?

Every case is different however, the most common amount you are entitled to receive is $50,000 for accident benefits, excluding any additional coverage which was purchased. These benefits are available for treatment for which OHIP does not cover as long as the treatment is within ten years of the accident. In some cases involving minor injuries, benefits are capped at $3,500. Note, these figures do not apply to every case and you are often entitled to more money for treatment in catastrophic cases.

What do I need to get treatment?

Your insurance company will provide the forms necessary so that you could get the healthcare you need. It’s important to note that your insurance company is entitled to deny payments for treatment if the treatment was not applied by a healthcare professional.  It’s important to visit registered healthcare professionals to get the treatment you need.
